The following terminology applies to these Conditions of Use and Sale : "Client", "Customer" "You", "Your” refers to you the person accessing this website and accepting the company’s Conditions or Use and Sale. “SkiHolidayExtras.com”, “The Company”, “Ourselves”, “We” and “Us” refers to the company SkiHolidayExtras.com. “Party”, “Parties”, or “Us” refers to both the Client and ourselves, or either the Client or ourselves. All conditions refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner and by whatever means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated products and services, in accordance with and subject to prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
1. Access to SkiHolidayExtras.com
We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Furthermore, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
2. Licence for website access
SkiHolidayExtras.com grants you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with our express written consent. This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.
You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of SkiHolidayExtras.com and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilising SkiHolidayExtras.com’s or its affiliates' names or trademarks without our express written consent. 3. Your conduct
You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. You understand that you, and not SkiHolidayExtras.com, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.
You must not use the website for any of the following:
a) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity
4. Conditions Relating to the Sale of Products to You
This section deals with conditions relating to the sale of products by SkiHolidayExtras.com to you, whether directly through SkiHolidayExtras.com or indirectly through one of our affiliates.
5. Electronic communications
When you visit SkiHolidayExtras.com or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
6. Our contract
When you place an order to purchase a product from SkiHolidayExtras.com, we will send you an e-mail confirming receipt of your order and containing the details of your order. This email confirms receipt of your order, however, we reserve the right to cancel or amend your booking as per the terms relating to cancellations and alterations outlined below.
7. Product Vouchers
Your voucher for the goods/services that you have reserved will be sent to you by email. This email, confirming receipt of your order, will contain a link which you will need to click in order to print out your vouchers. Should you not have received a confirmation email within 24 hours of making your booking, please contact email@example.com. The voucher will include all the information you need to collect your goods/services in resort. You must print the voucher and take it with you as proof of purchase whenever you are collecting your products from our agents or suppliers on site. SkiHolidayExtras.com cannot be held responsible for any consequences resulting from the clients failure to print out vouchers and take them to resort.
SkiHolidayExtras.com cannot refund clients unused portions of vouchers. If for any reason you should be unable to use all or any of the services booked, for any reason whatsoever, then a claim should be made to your insurance company. SkiHolidayExtras.com will endeavour to provide you with any documentation needed to make a claim with your insurance company. All requests for information should be made in writing to firstname.lastname@example.org
If you lose your voucher you must inform us as soon as possible in writing to email@example.com or by telephone before your departure to resort. If you fail to do this and we have no record of your purchase we may have to charge you again and refund you on your return if we find you have been charged twice. 8. Pricing and availability
All products listed on the website should be available, however, due to the large number of products on the website and the fluctuating seasonal availability of certain products SkiHolidayExtras.com cannot guarantee the availability of our full catalogue of products. As we process your order, we will inform you by e-mail and telephone if any of the products you have ordered turn out to be unavailable or if there is a change to the dates/times or availability.
When making a ski school booking within 4 weeks of your arrival date in resort we reserve the right to refuse the booking should ski school no longer be available, or to suggest alternative arrangements. Any extra costs involved in changing from the original product booked will be recharged to the client, any amount paid by the client over the cost of the final product will be refunded.
All skiholidayextras.com prices are based on the public prices found in resort with the majority of the time a discount for booking the service in advance. The discounts can vary depending on the service/product and range from 2% to 50%. Where there is more than one supplier of a product or service, our prices are based on the supplier rates of our specified supplier, and we do not accept responsibility for promotional activity of other suppliers in resort.
SkiHolidayExtras.com reserves the right to withdraw a product from the website before or after a purchase has been made should it be evident that there is an error in the pricing. All prices are based on the prices charged in resort, with discounts being given on these resort prices, if through human error a price has been entered incorrectly, a new invoice showing the correct pricing will be raised, and we will contact you to make any necessary reimbursement or take further payment if required.
Discount codes and promotions are strictly for direct customers and cannot be used on bookings through an agency account
All SkiHolidayExtras.com prices are in Euros. SkiHolidayExtras.com do not make any additional “hidden” charges for using a credit or debit cards, however if you are using a sterling credit or debit card to make your purchase, the amount that will finally be debited your account is dependent on the exchange rate used at the time of purchase by your bank or credit card company. Furthermore your bank or card provider may impose a charge for transactions completed in Euros. It is the customer’s responsibility to check, before completing their booking, any additional charges for which they are liable. SkiHolidayExtras.com accepts no responsibility for exchange rate fluctuations or additional charges imposed by banks or card providers. Should you have any queries or complaints about this, please take it up with your bank or card provider.
All prices are inclusive of VAT unless stated otherwise.
10. Confirming Price
Items in your Shopping Basket will always reflect the most recent price displayed on the item's product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your basket. Placing an item in your basket does not reserve the price shown at that time. It is also possible that an item's price may decrease between the time you place it in your basket and the time you purchase it.
Some discounts are time-limited offers. SkiHolidayExtras.com reserve the right to change any offers without notice and all offers negotiated, whether by email or phone, remain at the discretion of SkiHolidayEtxras.com management. Also, as the discount we are able to offer for any item is dependent upon its availability, SkiHolidayExtras.com's price will necessarily change on occasion.
11. Price Matching
SkiHolidayExtras.com does not offer a rigid price-match policy, however we strive to maintain competitive prices across our whole range of products and we will, at our discretion, attempt to match a lower price. Written confirmation of a lower price from a different supplier must be provided to SkiHolidayExtras.com before any discretionary price match is confirmed.
12. Bulk Discounts
SkiHolidayExtras.com will offer, at our discretion, a further discount to bulk or group orders. Please contact SkiHolidayExtras.com to enquire about this.
13. Trade up
You will be able to upgrade any products or services purchased from us whilst you are in resort provided:
a) the upgraded product is available
In the rare event that the company supplying your goods in resort does not have the product or service you requested you will be given the next available upgrade free of charge.
As per clause 9 above SkiHolidayExtras.com do not make any additional “hidden” charges for using a credit or debit cards. Please be aware that your bank or credit card provider may include an additional charge for transactions in Euros. Please check with your bank or card provider for the full terms and conditions on these charges.
We do our best to include all additional costs at the time of booking however we are not liable for any in-resort supplements or deposits suppliers may implement throughout the season.
Unless there is no availability for your product, you decide to upgrade, or it is clearly stated at the time of booking there will be no surcharges, save those mentioned below, once you have made your booking. The only other exception will be in the unlikely event that government action increases or imposes taxes not known at the time of publication.
As per clause 8 above, when making a ski school booking within 4 weeks of your arrival date in resort we reserve the right to refuse the booking should ski school no longer be available, or to suggest alternative arrangements. Any extra costs involved in changing from the original product booked will be recharged to the client, any amount paid by the client over the cost of the final product will be refunded.
If your flight is over an hour late you may be subject to paying a waiting fee to the driver in local currency. You may also be liable to pay a fee to the driver in local currency for any luggage in excess of that confirmed at the time of booking.
Certain third party ski hire suppliers may request a swipe of your credit card for their records and as guarantee against loss, theft or damage of equipment. This is common practice but will vary between suppliers. Your card will not be charged unless you fail to return the equipment or return damaged equipment.
15. Cancellations and Alterations by the customer
We operate a strict cancellations policy in order to protect ourselves from cancellation charges imposed third parties. All cancellations are strictly non-refundable, unless you have purchased our cancellation guarantee, at time of booking. This does not affect your statutory rights as outlined below.
Our cancellation guarantee costs €10 per booking and is completely non-refundable. Bookings where cancellation guarantee has been purchased can be cancelled, free of charge, up to 48 hours before your arrival date. For any bookings cancelled within 48 hours of your arrival date.
SkiHolidayExtras.com reserve the right to keep the total amount of your booking regardless of whether or not cancellation guarantee has been purchased. Where a cancellation occurs within 48 hours of the date of travel it is the customer’s responsibility to claim any losses thereby incurred from their insurance company. SkiHolidayExtras.com will endeavour to provide you with any documentation needed to make a claim with your insurance company. Under no circumstances (for example in the hope of profiting from a promotion or offer that intervenes between the booking date and the travel date) can a customer cancel and re-book with SkiHolidayExtras on the same date in the same resort. If the cancellation is a result of an accommodation change by the customer’s tour operator, then we will do our best to amend the booking for products in the new resort. Any additional costs involved in changing from the original product booked will be charged to the client. Where the new product is of a lesser value than the original product booked the amount paid by the client over the cost of the final product will be refunded.
Please make any cancellation requests in writing to firstname.lastname@example.org stating the date you made your booking, the booking reference number, the full amount of the booking, including any cancellation insurance and the reason for which you wish to cancel. As payment is taken in Euros (€) by SkiHolidayExtras.com, any refund will be for the same amount in Euros (€). SkiHolidayExtras.com is not liable for any fluctuation in the exchange rates, which could work either in your favour or against you.
We are happy to make make any modifications to your booking providing the products are available. Any additional costs involved in changing from the original product booked will be charged to the client. Where the new product is of a lesser value than the original product booked the amount paid by the client over the cost of the final product will be refunded. We reserve the right to charge a 5€ administration fee for any changes to bookings.
16. Cancellations or Alterations by SkiHolidayExtras.com
We check the accuracy of the information provided to you and to the best of our knowledge it is correct at the time of publishing.
We try at all times to meet your requirements, however we reserve the right to cancel or make alterations to any booking. Where a product or service becomes unavailable we will try to offer an alternative of a similar standard to those originally booked. Where no alternative is available SkiHolidayExtras.com reserves the right to cancel all or part of your booking and provide you with a full refund for the unavailable products or services. Where any alteration substantially alters your products or services we will give you the option of accepting goods of a comparable standard to those originally booked or of receiving a full refund of money paid.
Your Statutory Rights
17. Cooling-off Period
At SkiHolidayExtras.com we want you to be satisfied every time you shop with us. Occasionally though, we know you may want to return items. By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered, or in the case or purchase of products for delivery at a later date, as applies to all products on SkiHolidayExtras.com, within seven working days of the day after the date the confirmation email is received.
To cancel your purchase within the seven-working-day cooling-off period, please send your cancellation request in writing to email@example.com stating the date you made your booking, the booking reference number, the full amount of the booking, including any cancellation insurance and the reason for which you wish to cancel.
As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item or for the full booking if you choose to cancel all products ordered. 19. Claims and complaints
If you have a complaint regarding a purchase made through SkiHolidayExtras.com or a problem with a product booked through us whilst you are on holiday you must contact, where possible, our local agents in resort immediately or our admin contact number so that we can rectify the problem. The telephone number (which differs depending on you resort) will be on your voucher. You must notify us before starting to use the product or if the problem occurs at a later time, as soon as you become aware of the problem. Failure to allow SkiHolidayExtras.com to rectify the problem may affect your right to any compensation, although failure to notify us will not affect your statutory rights as a consumer. If we are unable to rectify the problem on the spot you must give our agent in France a written record of your complaint where possible and contact us again within 28 days of your returning from your holiday. If you decide that you need to purchase an alternative product or service in resort and you believe that SkiHolidayExtras.com are liable to refund you, it is essential that you retain any receipts or proofs of purchase.

We will try our best to resolve any complaint you may have with our service quickly and fairly, we are fully committed to the satisfactory resolution of any issues you may have.
Any contract made between the client and SkiHolidayExtras.com is governed in all respects by English Law.
SkiHolidayExtras.com are not liable for any injury, delay, loss, theft, damages or death as a result of extras supplied by a third party supplier. SkiHolidayExtras.com are not liable for any Industrial Action from our suppliers although we will do our best to recover any monies from the supplier on behalf of our customers SkiHolidayExtras.com will not be responsible for any loss, delay or costs connected with adverse weather conditions.
Following delivery of lift passes it is the clients sole responsibility for the safekeeping of the liftpass and any additional receipts relevant to their booking. SkiHolidayExtras.com are not responsible for the loss or theft of lift passes however, where possible we will do our best to assist in obtaining a replacement lift pass. All claims for compensation as a result of lost or stolen passes rest with the clients insurer and not SkiHolidayExtras.com
SkiHolidayExtras.com's third party skihire suppliers offer the option of damage and theft insurance, payable in resort, for the ski hire purchased through SkiHoilidayExtras.com. This insurance is not included in the purchase price of ski hire on our website and it is the client's responsibility to ensure that they are adequately insured against loss or theft, whether through their own insurance company or through the purchase of the insurance offered by third party suppliers. SkiHolidayExtras.com accepts no responsibility whatsoever for the loss, theft or damage of ski hire equipment.
SkiHolidayExtras.com accept no responsibility for the loss of lesson cards/vouchers/proofs of purchase or exchange provided to the client by third party ski school suppliers. It is the sole responsibility of the customer for the safekeeping of said lessons cards/vouchers/proofs of purchase or exchange. The replacement of such documents will be at the discretion of the third party ski school provider and SkiHolidayExtras.com accept no responsibility for the decision or actions of the third party supplier following loss or theft of such documents.
21. Special Clause : Lift Passes in France
Please note that lift passes sold in France through our website must be purchased alongside accommodation through our site or alongside a holiday booked with Ski France or an affiliated company. SHE reserves the right to cancel any lift pass bookings not complying with this requirement and refund clients.

23. Our data policy
We are on the UK Data Protection Register. We comply fully with all relevant data protection legislation in the territories in which we operate.
The information that we collect is that which you enter during the ordering and registration process. It is collected lawfully and in accordance with the Data Protection Act 1998.
We request information from you at various points on the site. We use these details to send out material from time to time that we think will be of interest to you.

24. Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
25. Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
27. Our details
Ski Holiday Extras trades under the registered company Ski France Travel Ltd. This website is owned and operated by Ski France Travel Ltd.
We are a Member of ABTA, Membership number Y0107 We are obliged to maintain a high standard of service to you by ABTA’s Code of Conduct. We can also offer you an arbitration scheme for the resolution of disputes arising out of this contract. The scheme is arranged by ABTA and administered independently. It is a simple and inexpensive method of arbitration on documents alone with restricted liability on you for costs. The upper limit on claims is £5,000 per person and £25,000 per booking form. The scheme doesn’t apply to claims which are solely in respect of physical injury or illness or their consequences. It can however deal with claims which include an element of minor injury or illness subject to a limit of £1,500 on the amount the arbitrator can award per person in respect of this element. Your request for arbitration must be received by ABTA within eighteen months of the date of return from holiday. For injury and illness claims, you can request the ABTA Mediation Procedure and we have the option to agree to mediation. Further information on the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com.
